PARTICIPATION

1. You are required to follow the rules and regulations of the League which will be made available to you by JEEL and are incorporated in these Terms by reference. JEEL shall have the right to disqualify you if you are found violating the rules and regulations of the game or the League or any other rules applicable to you.
2. JEEL, at its discretion reserves the right to modify the rules and regulations and you shall be bound by such revisions made by JEEL.

ACCESS TO THE SERVICE

1. License. Subject to these Terms, JEEL grants you a non-transferable, non-exclusive, revocable, limited license to use and access the Service solely for your own personal purposes, in accordance with the terms of this Terms.
2. Modifications of the Terms: JEEL reserves the right to change the Terms and the Terms may be further modified based on changes in the business, legal and regulatory requirements and will be updated online. You are encouraged to periodically visit this page to review these Terms and any changes to it.
3. Modification of the Service: JEEL reserves the right, at any time, to modify, suspend, or discontinue the Service (in whole or in part) with or without notice to you. We and our affiliates, licensors, and users, as applicable, reserve all rights in connection with the Service and its content, including, without limitation, the exclusive right to create derivative works.

JEEL’s name, logo, trademarks, and any JEEL product or service names, designs, logos, and slogans are the intellectual property of JEEL or our affiliates or licensors and may not be copied, imitated or used, in whole or in part, without our prior written permission in each instance. You may not use any metatags or other “hidden text” utilizing “JEEL” or any other name, trademark or product or service name of JEEL or our affiliates or licensors without our prior written permission. In addition, the “look and feel” of the Service constitutes the service mark, trademark or trade dress of JEEL and may not be copied, imitated or used, in whole or in part, without our prior written permission.

6. Feedback. We welcome feedback, comments, and suggestions for improvements to the Service (“Feedback”). You acknowledge and expressly agree that any contribution of Feedback does not and will not give or grant you any right, title, or interest in the Service or in any such Feedback. You hereby assign to JEEL any and all right, title, and interest (including, but not limited to, any patent, copyright, trade secret, trademark, show-how, know- how, moral rights and any and all other intellectual property right) that you may have in and to any and all Feedback.

SUSPENSION, TERMINATION, AND CANCELLATION.

USE LIMITATIONS

1. The Service enables you to register to participate in Leagues organized by JEEL.
2. As a condition of your use of the Servic e, you warrant to JEEL that you will not use p;the Service for any purpose that is unlawful or prohibited by these Terms. You may not use the Service in any manner which could damage, disable, overburden or impair the Services or interfere with any other party 's use and enjoyment of the Service.
3. You are not entitled to use any kind of measures, mechanisms or tools (software or hardware) that could interfere with the functioning of the Service or any part thereof;
4. You may not use the Services and/or Service bsp;if (i) you have been convicted of any offence un der applicable law; and/or (ii) if you are under the age eligible to play nbsp;the game or participate in the League, as provided on the Service.
5. You shall not host, display, upload, modify, publish, transmit, update or share any information which:
   1. Belongs to another person and to which you do not have any right to;
      1. Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographi c, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically, objectionable, disparaging, relating or encouraging money laundering or gambling or otherwise unlawful in any manner whatsoev er; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecen t Representation of Women (Prohibition) Act 1986;
      2. Is misleading in any way;
      3. Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
      4. Harassing or advocates harassment of another person;
      5. Involves the transmission of “junk mail”, “chained letters”, or unsolicited mass mailing or “spamming”;

1. Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
   1. Infringes upon or violates any third party’s rights (including, but not limited to, intellectual property rights, rights of privacy or rights of publicity);
   2. Promotes an illegal or unauthorized copy of another person’s copyrighted work;
      1. Provides instructional information about illegal activities such as making and/ or illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
      2. Solicits gambling or engages in an y gambling activity which we in our sole discretion believe is or could be construed to be as illegal;
         1. Harms minors in any way;
         2. Violates any law for the time being in force;
         3. Impersonates another person;
            1. Contains software viruses or any other computer code, files or programs designed to interupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptiously intercept or expropriate any system, data or personal information;
            2. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation;

GENERAL

1. Use Restriction: You must not access the Service if you are a person who is either barred due to age restrictions or otherwise legally prohibited from receiving or using the Service or any Services under the laws of India.
2. Third-Party Fees: You may incur access or data fees from third parties (such as your internet provider or mobile carrier) in connection with your use of Servi ces and of Service. You are solely responsible for all such fees.

Your participation in any nbsp;tournament/League would be interpreted as you having read the relevant rules and ensured your compliance of the same. DISCLAIMER AND WARRANTIES

1. You represent and warrant that the information provided by you, inclu ding third party information, to the best of your knowledge, are correct, not in violation of any applicable law, will not corrupt or disrupt the Services, and that you have the right to share such information. You are responsible for the accuracy of information uploaded by you on the Service and to keep such information up-to-date at all times.
2. Raising a false alarm or hoax call is a s erious offence and may lead to civil and/or criminal charges being brought against you. We encourage you to adopt rea sonable measures to prevent unauthorized and/or unsupervised access to the Service, including but not limited to unsupervised use of the Service by minors. JEEL s hall not be responsible for any such unauthorized and/or unsupervised access to the Service and any damages whatsoever thereof.

LIMITATION OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE p;LAW, IN NO EVENT SHALL JEEL BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOE VER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF, OR INABILITY TO USE OR ACCESS, THE SERVICE OR FOR ANY SECURITY BREACH OR ANY VIRUS, BUG, UNAUTHORIZED INTERVENTION, DEFECT, OR TECHNICAL MALFUNCTIONING OF THE SERVICE,WHETHER OR NOT FORESEEABLE OR WHETHER OR NOT JEEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR BASED ON ANY THEORY OF LIABILITY, INCLUDING BREACH OF CONTRACT OR WARRAN TY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT, OF OR IN CONNECTION WITH, YOUR USE OF, OR ACCESS TO, THE SERVICE OR THE CONTENT. YOU SHALL BE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ANY EQUIPMENT AND p;ANCILLARY SERVICES (INCLUDING THE PAYMENT OF ANY ADDITIONAL FEES THEREFORE) REQUIRED TO CONNECT TO, ACCESS OR OTHERWISE USE THE SERVICES, INCLUDING, WITHOUT LIMITATION,VIDEO-ENABLED DEVICES, VIDEO COMMUNICATION SERVICES, MODEMS,HARDWARE, SERVERS, SOFTWARE, OPERATING SYSTEMS, NETWORKING, WEB SERVERS, INTERNET AND TELEPHONE SERVICE (COLLECTIVELY, “EQUIPMENT”).YOU WILL ALSO BE RESPONSIBLE FOR MAINTAINING THE SECURITY OF THE EQUIPMENT AND FOR ALL USES OF THE EQUIPMENT WITH OR WITHOUT YOUR KNOWLEDGE OR CONSENT.

ALL SUCH INFORMATION, SOFTWARE ;AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. JEEL AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, AND SERVICE, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A P ARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

YOU SPECIFICALLY AGREE THAT JEEL SHALL NOT BE nbsp;RESPONSIBLE FOR UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY sp;TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. YOU SPECIFICALLY AGREE THAT JEEL IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL SERVICES OR CONDUCT OF ANY OTHER PARTY OR ANY IN FRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT JEEL IS NOT RESPONSIBLE FOR ANY SERVICES SENT US ING AND/OR INCLUDED IN THE SERVICE BY ANY THIRD PARTY.

IN NO EVENT SHALL JEEL AND/OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIR ECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR OR IN R ELATION TO: (A) LOSS OF USE, DATA OR PROFITS ARISING OUT OF OR IN ANY WAY CONNE CTED WITH THE USE OR PERFORMANCE OF SERVICE; (B) ANY DELAY OR INABILITY TO USE THE SERVICE OR SERVICES; (C) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION OR SERVICES OBTAINED THROUGH THE SERVICE; (D) OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICE OR THE SERVICES OF JEEL; WHETHER OR NOT ALL OF THE ABOVE LOSSES, ;CLAIMS OR DAMAGES ARE BASED ON CONTRACT,TORT, NEGLIGENCE, STRICT LIABILITY, EVEN IF JEEL AND/OR ITSAFFIL IATES AND/OR ITS ASSOCIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES, CLAIMS OR DAMAGES.
5. THE SERVICE IS CONTROLLED AND OFFERED BY JEEL nbsp;FROM INDIA. JEEL MAKES NO REPRESENTATIONS THAT THE SERVICE IS APPROPRIATE OR AVAILABLE FOR USE IN OTHER LOCATIONS. THOSE WHO ACCESS OR USE THE SERVICE FROM OTHER JU RISDICTIONS DO SO AT THEIR OWN VOLITION AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.

INDEMNITY

• To the extent permitted by applicable law, you agree to defend, p;indemnify and hold harmless JEEL, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms ; (iii) your violatio n of any third party right, including without limitation any copyright,property, or privacy right. It may be noted that this indemnity clause shall survive even if you cease to be the user of Global e-Cricket Premier League mobile app and website.

INJUNCTIVE RELIEF

• You agree that a breach of these Terms will cause irreparable injury to JEEL for which monetary damages would not be an adequate remedy and JEEL shall be entitled to equitable relief in addition to any remedies it may have hereunder or at law without ;a bond, other security, or proof of damages.

GOVERNING LAW AND VENUE

• JEEL shall be under no liability whatsoever in the event of non-availability of any portion of the Service occasioned by act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, failure of any public utility, man-made disaster, infrastructure failure or any other cause whatsoever beyond the control of JEEL.

SEVERABILITY

• If any of the provisions of these Terms are deemed invalid, void, or for any reason unenforceable, that part of these Terms will be deemed severable and will not affect the validity and enforceability of any remaining provisions of these Terms.

ASSIGNMENT

• These Terms, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without JEEL’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. JEEL may freely assign these Terms. The terms and conditions set forth in these Terms shall be binding upon assignees.
